Alternatively, you can also enter the sweepstakes by emailing hello@funnyretriever.com with the subject line FUNNY RETRIEVER SWEEPSTAKES and providing your name, complete address and telephone number (including area code). All email entries must be received by 11:59:59 PM ET on November 26, 2021 to be eligible for entry. Purchase does not increase chances of winning. The promotion runs from November 2 to November 26 at 12:00 AM. On December 4, 5 winners will be announced at 2 pm EST via Facebook Live. The 5 winners will be chosen at random. If winner does not respond within 7 days, prize will be forfeited.
II. 5 winners will receive the giveaway items mailed via UPS or a carrier of sponsor’s choice. Sponsor expressly disclaims any liability arising out of any delay or failure to deliver the prize due to reasons beyond Sponsor’s reasonable control, including without limitation interruption, defect or delay in operation or transmission over the Internet, electronic or electrical interference, system failure or computer virus if the prize is delivered electronically, or any delays or delivery failures caused by weather conditions, fire, strikes, boycotts, delays in transportation, etc. if the prize is delivered by overnight courier. No combinations. No substitutions, cash equivalents, or transfer of the prize are permitted, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value.
Odds of winning each prize will depend upon the number of eligible entries received.
The prize is nontransferable and must be accepted as awarded. The prize will be awarded only if properly claimed. Limit one (1) prize per household. Unclaimed prizes will be forfeited. In the unlikely event that the prize is unavailable for any reason beyond Sponsor’s reasonable control, the winners agree that Sponsor shall have no further obligation to winners.
The prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Eligible entries are those in which all entries have been completed correctly and otherwise comply with these Official Rules. Sponsor reserves the right to disqualify any participant or winner and may refuse to award the prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means.
III. Eligibility. This promotion is open to legal residents of the United States and the District of Columbia (excluding residents of Puerto Rico, U.S. Virgin Islands and Guam), 21 years of age or older at the time of entry. Funny Retriever employees and their immediate families are not eligible for this promotion.
IV. Conditions. By entering, each entrant accepts and agrees to be bound by these rules and decisions of Funny Retriever. Any taxes or other expenses not specified herein are the sole responsibility of the winner. Winners may be required to execute and return within fourteen (14) days of date printed on notification, an Affidavit or Eligibility and Liability/Publicity Release, and any other documentation Funny Retriever reasonably requires for prize fulfillment. Failure to comply with the requirements of this paragraph (or the return of the prize or notification as non-deliverable) may result in disqualification and in the forfeiture of any right to the prize, in which case the prize will be awarded to an alternate participant by random drawing. If a prize notification or prize is returned as undeliverable, the corresponding prize will be forfeited. By accepting a prize, the winner agrees that Funny Retriever accepts no responsibility or liability in connection with injuries, losses, or damages of any kind caused by or resulting from the acceptance, possession or usage of the prize awarded hereunder. All taxes and fees are each winner's responsibility.

V. Participation. By submitting an Entry, entrants grant Funny Retriever a perpetual and unrestricted license to use their names and images and any submitted content, in any format, provided in connection with their sweepstakes entries in advertisements and/or promotions without further compensation. Winner, by acceptance of prize, except where legally prohibited, grants permission for Funny Retriever and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in any and all media now known or hereafter discovered, worldwide, and on the Internet, and world wide web, in perpetuity, without notice or review or approval. The use of personal information collected in the course of the sweepstakes shall be governed by the terms of Funny Retriever’s Privacy Policy. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges (if applicable).
By participating in the sweepstakes and/or accepting the prize, a participant/winner agrees to defend, release and hold harmless the Sponsor and its parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, employees, representatives and agents from and against any actions, claims and/or liability for injury, loss or damage of any kind, (including the violation or infringement of any proprietary or personal right of any individual or entity) resulting in whole or in part, directly or indirectly, from participation in the sweepstakes, and/or the use, acceptance, or possession of the prize, and/or participation in a sweepstakes prize-related activity, including any action, claim or liability arising from the unauthorized submission of any information.
VI. Limitations of Liability. By entering the sweepstakes, entrants hereby agree that all disputes, claims, and causes of action arising out of or in connection with the sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action. Any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and associated with entering the sweepstakes, if any. Entrant hereby specifically waives the right to claim that any attorney’s fees be awarded and under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, any and all punitive, incidental or consequential damages of any kind and any and all rights to have damages multiplied or otherwise increased. Funny Retriever and its affiliates are not responsible for lost, late, incomplete, incorrect, inaccurate, stolen, delayed, misdirected, undelivered, garbled or illegible entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or malfunctions of any kind whether human, typographical, printing, mechanical, electronic or network relating to or in connection with the sweepstakes, including without limitation, errors or malfunctions which may occur in connection with the administration of the sweepstakes, the processing of entries, the announcement of the prize or in any sweepstakes-related materials. Funny Retriever is also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Funny Retriever is not responsible for injury or damage to entrants’ or to any other person's computer related to or resulting from participating in this sweepstakes or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the sweepstakes or website, or who are in violation of these Official Rules, as solely determined by Funny Retriever will be disqualified. VII. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these official sweepstakes rules, or the rights and obligations of any contestant and their affiliated organization and Funny Retriever, shall be governed by, and construed in accordance with the laws of New York, without giving effect to any choice of laws or conflict of laws rules or provisions that would cause the application of the laws of any jurisdiction other than New York. In the event that any provision herein is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provisions were not contained therein and the provisions deemed unenforceable or invalid by a court of competent jurisdiction shall be blue penciled as narrowly as possible in order to make the provisions valid and enforceable.
VIII. USE OF DATA: Funny Retriever will be collecting personal data about entrants online, in accordance with Funny Retriever’s Terms of Use. By entering the sweepstakes, each entrant acknowledges that he or she has read and accepted Funny Retriever’s Terms of Service and Privacy Policy and agrees to Funny Retriever’s usage of his or her personal information.
